Anyone who has shopped at some of the nation’s massive home improvement stores may have experienced a near miss from falling objects when trying to retrieve merchandise from the towering shelves packed with items ranging from construction supplies to landscaping materials. Recently, a Massachusetts man filed a law suit against Home Depot, claiming that he was stuck by a piece of pipe which fell from an overhead shelf as he was trying to retrieve a plastic bin. According to the New Hampshire Union Leader newspaper, when the plaintiff attempted to dodge the falling object, he felt a popping sensation in his neck and shoulder and, despite his efforts, the 1 1/2 diameter pipe struck him on the head leaving two distinct indentations. The resulting injuries allegedly impacted the victim’s ability to perform his job and he claims he incurred significant medical expenses, lost wages and other economic losses due to the defendant’s negligence.
